Gut Journal (Poop Diary) is a personal health tracking tool for informational and personal tracking purposes only.
THE APP DOES NOT PROVIDE MEDICAL ADVICE. The information provided is for general informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider.
Subscriptions are billed through Apple App Store or Google Play Store. They automatically renew unless canceled at least 24 hours before the end of the current billing period. In-app purchases (such as the Dog Profile Add-On) are non-refundable except as required by applicable law.
You retain ownership of all data and content you create within the App. Since all data is stored locally on your device, you are solely responsible for maintaining backups.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUPKIKI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $10, WHICHEVER IS GREATER.
The App is provided on an "as-is" basis for personal tracking purposes only. We do not warrant that the App will be uninterrupted, error-free, or that information provided is accurate or complete. This disclaimer does not exclude liability for gross negligence or willful misconduct.
We encourage you to contact us first at hello@gut-journal.com to resolve any disputes informally. If we cannot resolve a dispute informally, you agree that any dispute arising from these Terms shall be resolved by binding arbitration conducted on an individual basis. For claims under $5,000, you may choose to pursue the dispute in small claims court instead of arbitration.
You may opt out of arbitration by sending written notice to hello@gut-journal.com within 30 days of first using the App. If you opt out, disputes will be resolved in the courts of California.
You agree to indemnify and hold harmless CupKiki from any claims arising from your use of the App or violation of these Terms.
Since all data is stored locally on your device, we are not responsible for any data loss resulting from device failure, software updates, or app uninstallation. You are solely responsible for backing up your data.
These Terms shall be governed by the laws of the State of California, United States.
